These Terms of Sale (“Terms”), along with our Terms of Use, Privacy Policy, and any other policies referenced herein, form a binding agreement (“Agreement”) between you (“You”, “Your”, “User”) and Cbizzle Ltd, including its affiliates, successors, and permitted assigns (“Cbizzle”, “We”, “Us”, or “Our”).
By using our website (“Site”), mobile or web applications (“App”), or any other service, tool, or technology we provide (collectively, the “Platform”), you confirm that you accept these Terms and agree to follow them.
If you do not agree with these Terms, you must refrain from using the Platform. Please take the time to read this Agreement thoroughly before proceeding.
We may update or revise these Terms at any time by posting changes on the Platform. It is your responsibility to review them periodically. Continued use of the Platform after updates constitutes your acceptance of the revised Terms.
When you accept these Terms, you also do so on behalf of anyone you authorise to use your Cbizzle account. It is your responsibility to ensure such authorisation is valid.
2. What We Provide
Cbizzle serves as a digital marketplace that connects Buyers and Sellers. Acting as a disclosed agent, we allow Sellers to present a wide range of goods and services, from electronics and vehicles to property, lifestyle products, art, business services, jobs, and more.
We may, from time to time, introduce new features, tools, or applications which may require you to accept additional terms or fees. We also reserve the right to suspend or discontinue parts of the Platform at our sole discretion, without liability.
While we strive to maintain accurate information, Cbizzle does not guarantee that product descriptions, specifications, pricing, or other details are always error-free, complete, or current.
3. Buying & Selling on Cbizzle
3.1 Seller Responsibilities
Sellers must ensure their listings are accurate, transparent, and up to date. Clear terms of sale, fair postage and handling fees, prompt responses to Buyer queries, and professional conduct are expected. Failure to comply may result in restrictions, listing removal, account suspension, or fees to cover enforcement costs.
3.2 Listing Rules
When listing an item, you agree:
You take full responsibility for the item and the accuracy of your listing.
Your listing may take some time to appear in search results.
Fixed-price listings may auto-renew monthly unless ended by you or by us.
Listings must comply with our policies.
We may revise or remove listing data if it violates our rules.
Placement in search results depends on numerous factors including Buyer location, price, Seller performance, and relevance.
Duplicate listings, prohibited items, and misleading content are not allowed.
3.3 Buyer Commitments
By purchasing on Cbizzle, you agree that:
You must read the full listing before buying.
You enter a binding contract when you buy or win an auction.
Ownership of items transfers directly between Seller and Buyer (Cbizzle does not hold title).
For vehicles and property, offers/bids represent an intention to purchase but may not constitute a formal contract until separately agreed.
3.4 Prohibited Items & Conduct
Items that may not be sold include: illegal goods, stolen property, counterfeit products, firearms, explosives, hazardous substances, narcotics, and any other items restricted under applicable law.
Fraudulent activity, spamming, phishing, creating fake accounts, or any attempt to undermine the integrity or security of the Platform is strictly forbidden.
We reserve the right to suspend accounts, remove listings, and report unlawful behaviour to authorities.
4. Payments
4.1 Buyers
We offer various payment methods, including debit/credit cards, cryptocurrency, and (in limited cases) cash on delivery. By entering your payment details, you authorise us to process applicable fees in AED or cryptocurrency.
Prices shown are set by Sellers and may be subject to VAT. While we aim for accuracy, errors may occur, and we reserve the right to correct them.
Payments are securely processed through third-party gateways, and neither we nor Sellers have access to your card details. Transactions are subject to verification by the issuing bank.
4.2 Sellers
By selling on Cbizzle, you agree to our commission structure. Fees currently include:
2.9% + AED 1 for card payments
2% + AED 1 for crypto payments
Commissions may vary by category, and advance notice will be provided for any changes.
5. Delivery
Deliveries are handled by third-party couriers (e.g. Aramex, Transguard).
Orders are confirmed only after payment approval.
Delivery costs and timelines will be displayed at checkout.
We are not responsible for unavoidable delays but will take steps to minimise them.
If delivery cannot be completed, you will be contacted to rearrange.
Proof of ID may be required upon receipt.
Ownership passes once delivery is completed and payment received.
6. Force Majeure
Cbizzle shall not be held liable for delays or failure to perform due to events beyond our control (natural disasters, strikes, pandemics, system failures, government actions, etc.).
7. Refunds & Cancellations
Refunds and cancellations are subject to each Seller’s individual policy. Cbizzle may, at its discretion, facilitate adjustments or improvements to ensure a fair Buyer experience.
8. Property Listings
For sales or rentals of property, Cbizzle is not responsible for the legal transfer or tenancy arrangements. Responsibility rests solely with the Buyer and Seller.
9. Warranties & User Obligations
You confirm that you:
Will comply with all applicable laws and regulations.
Have authority to enter into agreements.
Will not post infringing, unlawful, or misleading content.
Will not attempt to hack, reverse engineer, or scrape our Platform.
Will comply with our Community Guidelines.
10. Limitation of Liability
Our Platform is provided “as is”. To the fullest extent permitted by law, Cbizzle disclaims all warranties, whether express or implied.
We shall not be liable for:
Any indirect or consequential losses.
Third-party conduct, including Sellers, Buyers, or couriers.
Data loss, errors, system interruptions, or security breaches.
11. Indemnity
You agree to indemnify and hold harmless Cbizzle and its affiliates against claims, damages, or expenses arising from your use of the Platform or your breach of these Terms.
12. Entire Agreement
These Terms, together with our other published policies, form the entire agreement between you and us, superseding all prior communications.
13. Governing Law & Disputes
These Terms are governed by the laws of the United Arab Emirates.
Disputes shall be referred to arbitration under the ICC Expedited Rules of Arbitration in Dubai, UAE, conducted in English, before a sole arbitrator.
14. Miscellaneous
If any provision is found unenforceable, the remainder will still apply.
Our failure to enforce a right is not a waiver of that right.
We may terminate your account or restrict access at any time without prior notice.
You may stop using the Platform at any time by deleting your account.
