Welcome to Cbizzle.com. These Terms & Conditions (the “Terms”) govern your use of our website, services, listings, and transactions. By accessing or using Cbizzle.com (“we”, “us”, “our”, “Cbizzle”), you agree to be bound by these Terms. If you do not agree, please do not use our site.

1. Definitions

• User / you: any person who accesses or uses Cbizzle.com, including browsing, registering, buying, or listing items.
• Seller: a user who lists items (goods or services) for sale or classified listing on Cbizzle.
• Buyer: a user who purchases or enters into a transaction for goods or services listed by a Seller.
• Listings: classified or product offerings by Sellers, including used/new goods, descriptions, prices.
• Transaction: when a Buyer purchases or agrees to purchase a Listing from a Seller.
• Content: text, images, video, reviews, ratings, or any data uploaded to or appearing on Cbizzle (by users or us).

2. Eligibility

• You confirm you are at least 18 years old and have full legal capacity to enter into contracts.
• If you use the site on behalf of a business or entity, you represent that you have authority to bind that entity.

3. Account Registration & Use

• To buy or sell, you may need to create an account, providing accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must notify us immediately of any unauthorized use of your account or other security breach.

4. Listings & Seller Obligations

• Sellers must ensure that all Listings are accurate, lawful, honest, and not misleading. This includes correct descriptions, condition of item, pricing, any defects.
• Sellers are responsible for complying with all applicable laws regarding the goods/services they list (e.g., licensing, import/export, intellectual property).
• Sellers must respond to inquiries in a timely manner and fulfill accepted Transactions in accordance with agreed terms (delivery, returns, refunds if applicable).

5. Buyer Obligations

• Buyers must ensure they understand the product or service before purchase (including condition, shipping costs, taxes, etc.).
• Payment must be made through agreed payment methods. Delays or failure to pay may result in cancellation or other penalties.
• Buyers are responsible for providing accurate shipping or delivery address and any required customs or local fees if buying cross-border.

6. Pricing & Payments

• Prices are expressed in the chosen currency (AED or others, as displayed). Prices do not always include shipping, handling, customs, taxes, or other charges unless explicitly stated.
• We may collect a commission from Sellers, service fees, or other charges for use of the platform. These fees will be disclosed to the Seller.
• We are not responsible for payment delays due to banks, payment processors, or third parties.

7. Delivery, Shipping & Risk of Loss

• Sellers are responsible for arranging shipment or pickup, unless otherwise agreed. Delivery times are estimates.
• Risk and title to goods generally transfer to the Buyer upon delivery (or as defined by the shipping arrangement).
• Buyers are responsible for inspecting goods upon arrival. Any damage or discrepancies must be reported within a reasonable time.

8. Returns & Refunds

• Sellers must provide a returns/refund policy (if applicable) at the time of listing. Failure to do so does not relieve a Seller’s obligations under applicable consumer law.
• In case of faulty, misdescribed, or damaged goods, Buyers may have the right to return and/or receive a refund, as per seller policy (or legal requirement).
• For non-faulty goods, return policies are at Seller’s discretion, unless mandated by law.

9. Intellectual Property

• All content on Cbizzle (except user-uploaded content) is owned by or licensed to us. You may not use, reproduce, distribute, or otherwise exploit that content without our express permission.
• For user-uploaded content (listings, images, reviews), you grant Cbizzle a non-exclusive, royalty-free, worldwide license to host, display, distribute, adapt, and use such content in connection with the platform.
• Users must not upload content that infringes copyright or other rights of third parties.

10. Prohibited Conduct

You agree not to:

• Post listings or content that is illegal, offensive, misleading, infringing, or otherwise harmful.
• Use the platform to engage in fraud, spamming, or any unauthorized commercial activity.
• Violate local, national, or international laws, including consumer law, trade regulations, import/export restrictions.
• Impersonate someone else or misrepresent your affiliation with any person or entity.
• Tamper with or breach security of the site or disrupt its operations.

11. Disclaimers & Limitation of Liability

• The platform is provided “as is” and “as available” without warranties of any kind, either express or implied (fitness for a particular purpose, merchantability, non-infringement, etc.).
• We do not guarantee that transactions will be completed, that Listings are accurate, or that all Sellers will fulfill obligations.
• To the fullest extent permitted by law, Cbizzle, its officers, employees, agents, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages, losses of profits, business, data, or goodwill arising from using the site or any transaction.
• Our liability to you in respect of any event or series of events is limited to the amount you paid in Fees or for the transaction (if any). If no payment was made, our liability is zero.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cbizzle (and its officers, directors, employees, agents) from any claims, damages, losses, liabilities arising out of your breach of these Terms, your negligence, your misuse of the site, or your violation of any laws or rights of third parties.

13. Termination

• We may suspend or terminate your account, access to the site, or Listings if you violate these Terms or for any other reason at our discretion.
• Upon termination, you must cease use of the site, remove your content (if applicable), and fulfil any pending obligations (e.g. transaction commitments).
• Termination does not affect rights or obligations that accrued before termination.

14. Modification to Terms

• We may modify these Terms at any time. We will post the updated version on the site and update the “Last Updated” date. Your continued use after modifications constitutes acceptance of those changes.
• If changes are material, we may notify users via email or prominent site notice.

15. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of Applicable Jurisdiction.
• Any dispute arising out of or relating to these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts

16. Severability

• If any provision of these Terms is held invalid or unenforceable under applicable law, that provision shall be modified to the extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
